Lake Creek Project, FERC Project No. 2594 Document Distribution and Communications Protocols

1.0 Documents and Mailing Lists

1.1 Introduction

Northern Lights Inc. (NLI) is relicensing its Lake Creek Project, FERC Project No. 2594 using FERC's Integrated Licensing Process (ILP). The ILP regulations (for more details on FERC processes go to www.ferc.gov) define very specific procedures and timelines for the ILP. The ILP is designed to be a transparent process that involves all interested parties including tribes,agencies, non-governmental organizations and the public. As such NLI will carefully document the entire process including any information received from the interested parties as well as records of communications. To keep the interested parties informed regarding the process, NLI will maintain are licensing web-site, and make other information available at its corporate offices in Sagle, Idaho.

Copies of all mailing lists,announcements, notices, communications, and other documents related to there licensing of the Lake Creek project may be found on the Lake Creek website at http://www.norlight.org/LCRelicensing. NLI will regularly update the website to ensure the public has the latest information related to the relicensing process available to them and that all public documents are available. 1.2 Mailing Lists

There are two categories of participation in a FERC relicensing and each requires different notification or frequency and type of communication. Interested Parties are a broad group of individuals and governmental and non-governmental entities that have an interest in the relicensing; sometimes this group is referred to as"stakeholders." NLI will maintain a Lake Creek Relicensing Mailing List of all Interested Parties. The list will include both standard Post Office addresses and available email addresses for distributing notices and documents for public review.

Relicensing Participants area subset of Interested Parties. Relicensing Participants are the individuals and entities that are actively participating in a proceeding. Any Interested Party may elect to be a Relicensing Participant. Relicensing Participants generally are active on committees or specific aspects of the relicensing and receive additional communications relative to the specific activity or function.

After NLI files its License Application (scheduled for 2009), FERC will establish an official Service List for parties who have formally intervened in the proceeding. Intervention is a formal legal process in the FERC regulations. Additional information maybe found on FERC's Website at www.ferc.gov. Once FERC establishes a Service List, any written documents filed with FERC must also be sent to the Service List. A Certificate of Service must be included with the document filed with FERC.

1.3 Public Reference File

NLI will maintain an electronic public reference file on the Lake Creek website at http://www.norlight.org/LCRelicensing. The public reference file is a listing of important materials pertaining to the relicensing. This includes background reference material as well as the consultation record, all relevant studies and data collected during the development of the Pre-Application Document, meeting summaries, notices,reports as well as Project documents such as the current FERC license. Hard copies of all documents are available upon request as described above. Documents are available for inspection at NLI's office at 269 Chevy Street in Sagle, Idaho.

1.4 Restricted Documents

Certain Project related documents are restricted from public viewing in accordance with FERC regulations. Critical Energy Infrastructure Information (CEII) (18 CFR 388.113) related to the design and safety of dams and appurtenant facilities, and that is necessary to protect national security and public safety are restricted. Anyone seeking CEII information from FERC must file a CEII request. Information may be found on FERC's website at www.ferc.gov/help/how-to/file-ceii.asp.

Information related to protecting sensitive archaeological or other culturally important information is also restricted under Section 106 of the National Historic Preservation Act. Anyone seeking this information from FERC must file a Freedom of Information Act(FOIA) request. Instructions for FOIA are available on FERC's website at www.ferc.gov/legal/ceii-foia/foia.asp.

2. Communications Protocols

2.1 Document Distribution

NLI will, whenever possible, distribute all documents electronically in standard MS Word format or PDF. Some documents may also be distributed in hard copy either for convenience or by request. The following guidelines will be used to distribute information related to the Lake Creek Relicensing.

2.2 Providing Documents to NLI

NLI prefers to receive all documents electronically in either PDF or an appropriate MS Office format. Electronic documents may be emailed to LCRelicensing@norlight.org.Hard copy documents may be mailed to Mark Contor, Northern Lights, Inc, P.O. Box 269, 421 Chevy Street, Sagle, ID 83860. In either case, all documents received become part of the consultation record for the relicensing and may be distributed to the public as appropriate.

2.2 Meetings

NLI recognizes that there are a number of tribes, agencies,groups and individuals that may want to participate in the process. NLI will work with all Interested Parties to develop schedules and to hold meetings at the most practical locations and times to accommodate the majority of participants. NLI will post a calendar of relicensing meetings on the relicensing website as far in advance as practicable. In general, meetings,other than FERC Scoping Meetings, will be held between the hours of 9:00 a.m. and 4:00 p.m. FERC Scoping meetings will include at least one evening meeting. Every effort will be made to begin and end meetings on time.

NLI will notify all Interested Parties at least two weeks in advance of the next planned public meeting. At that time a meeting agenda and anticipated meeting schedule will be provided on the website and by email. NLI will also distribute any documents or other information that will be the subject of meeting discussions.

2.3 General Communications

Communications include written correspondence, emails, and notes from individual and conference telephone calls. Records of these communications(including copies of email or telephone discussion notes) may be posted on the Lake Creek Relicensing Website, as appropriate. NLI's goal is to keep the lines of communication open during the relicensing process and make it easy for relicensing participants and the general public to get information and to be informed of the interests of other Interested Parties.

2.4 Study Requests

In the development of the Pre-Application Document (PAD), NLI will collect and summarize the information available regarding the Lake Creek project and its effects on the human and natural environments. The PAD,however, may also indicate areas where there is little or no information related to areas of potential critical concern. In those cases, Relicensing participants may request additional studies or investigations to add to the knowledge of the Project. The ILP requires specific information from parties requesting studies related to the relicensing. Draft Study requests should follow the following format; NLI will assist parties with study requests as requested.

As specified by CFR 18, § 5.9(b)of FERC's regulations on the ILP, any study request must:

  1. Describe the goals and objectives of each study proposal and the information to be obtained;
  2. If applicable, explain the relevant resource management goals of the agencies or Indian tribes with jurisdiction over the resource to be studied;
  3. If the requester is a not resource agency, explain any relevant public interest considerations in regard to the proposed study;
  4. Describe existing information concerning the subject of the study proposal, and the need for additional information;
  5. Explain any nexus between project operations and effects (direct, indirect, and/or cumulative) on the resource to be studied, and how the study results would inform the development of license requirements;
  6. Explain how any proposed study methodology (including any preferred data collection and analysis techniques, or objectively quantified information, and a schedule including appropriate filed season(s) and the duration) is consistent with generally accepted practice in the scientific community or, as appropriate,considers relevant tribal values and knowledge; and
  7. Describe considerations of level of effort and cost, as applicable, and why any proposed alternative studies would not be sufficient to meet the stated information needs.

The requestor should also describe any available cost-share funds or in-kind services that the sponsor of the request may contribute towards the study effort.
